Welcome to LU-TRITION. These Terms and Conditions (“Terms”) govern your access to and use of our website (www.lutrition.com.au) and our services, including but not limited to dietetic consultations, digital products, e-books, and other resources.


By accessing our site or using our services, you agree to be bound by these Terms and our Privacy Policy (linked when uploaded). If you do not accept these Terms, please cease using the site and services immediately.

Acceptance of Terms
By accessing our website, booking a service, downloading or purchasing products (including digital content and e-books) you agree to be bound by these terms and our privacy policy. Please read them carefully.
If you do not agree, please cease using our website and Services.


Users of our site or services must be 18 years of age or older, and by using our site or services you warrant that you are at least 18 years of age and that the Services are being acquired for yourself, or on behalf of your child over the age of 13 years where you are that child’s parent or legal guardian.

Nutritional Information
All nutrition content is based on evidence-based practice and the best available research at the time, however, no guarantee is given as to the accuracy, completeness, or suitability for your specific needs.
Nutrient data may be estimated, variable between brands or sources, or calculated via recipe modelling. Always consult your dietitian or health provider before acting on such information.


Dietetic Services
We provide a range of services including individual dietetic consultations (in-person and telehealth), free 15-minute discovery calls, personalised nutrition plans and resources, downloadable e-books and other digital tools. All services are provided by an Accredited Practising Dietitian registered with appropriate governing body (Dietitian’s Australia) and are intended for clients aged 18 years and over. For clients under 18, a consenting parent or legal guardian must be actively involved in the consultation process. We do not offer services to children under the age of 13 years old.


Bookings:
Appointments can be booked via our website, email, phone, or social media channels. You will receive a confirmation email with appointment details after booking. Please ensure all information provided is accurate and complete to support appropriate service delivery.


Payments & Rebates:
In-person: Payment is due on the day via HICAPS EFTPOS terminal. Private health fund rebates can be claimed on the spot and only the gap fee will be payable. Medicare rebates require full payment upfront and rebated onto a debit card following payment.
NDIS: if applicable, we’ll issue an invoice for submission to the portal. Payment is due after funding is processed.


Telehealth: invoices sent via email following the appointment. Payment is due by the date on the invoice. A payment receipt will be provided once funds have been received, which can be utilised to claim Medicare or Private Health Fund rebate for those eligible.
NDIS Participants: If you are eligible for dietitian services under your NDIS plan, an invoice will be provided for submission through the NDIS portal. Payment is to be made via bank transfer once the funds are released.


Cancellation and Rescheduling:
To ensure that we can accommodate all our clients and manage our schedule effectively, we have established the following cancellation policy:


Cancellations require at least 24 hours’ notice
Late cancellations: 50% of the consultation fee may be charged
No shows: Full fee applies
Repeated no-shows may result in the need to prepay for future appointments or the termination of our therapeutic relationship


We understand that emergencies and unforeseen circumstances can arise. In such cases, please contact us as soon as possible, and we will consider waiving the cancellation fee on a case-by-case basis.


We are a small business and really appreciate your understanding and cooperation in adhering to our cancellation policy. This helps us maintain a smooth and efficient scheduling process and ensures that we can provide the best possible care to all our clients. If you have any questions or concerns about our cancellation policy, please do not hesitate to contact us.


Confidentiality:
We comply with the Privacy Act 1988 (Cth) and HRIP Act (NSW). Your personal and health information is collected solely for the provision of high-quality, individualised dietetic care. For more, see our Privacy Policy.


Limitation of Liability:
While we strive to provide the best possible advice and service, Lucinda Smith (TA Lutrition) is not liable for any adverse effects resulting from following the dietary and nutritional advice provided.


The advice given is based on the information provided by you and should not be considered a substitute for medical advice from your healthcare provider.


Appointment Changes:
In the event of staff illness or unavoidable disruption, we may need to reschedule appointments and will notify you promptly.


Changes to Services & Fees:
We reserve the right to change, update or remove any of our services at any time.

The prices for Services provided under these Terms of Use will be as set out on the Site at the time you apply for the Services.

All prices are in Australian Dollars unless otherwise stated, and inclusive of GST, and you agree that we may charge you GST as set out in the A New Tax System (Goods and Services Tax) Act 1999 (“GST Act”).

We reserve our right to amend our prices at any time without notice to you.

Digital Products
We offer downloadable e-books and resources. They are delivered via download link or email after purchase. You may not share, republish, attempt or redistribute our digital materials.


Due to the nature of digital products, we do not offer refunds for eBooks or downloads once delivered. If you receive the incorrect product or experience a technical issue, we will work to resolve this promptly. Your rights under the Australian Consumer Law are unaffected.


Use of Our Website
You agree to use our website and services for lawful, personal, non-commercial purposes only and without infringing on the rights of others or violating applicable laws.


You must not:
Distribute or copy content without permission
Upload harmful software or attempt unauthorised access
Use scraping, bots, or automated tools to collect data
We are not responsible for any loss or damage caused by your use of our website or services. The content of third-party links or advertisements.


Intellectual Property & License
All content on our site (including logos, graphics, documents, resources, and eBooks) is protected by copyright and intellectual property laws.


You are granted a limited, personal, non-commercial, revocable licence to use this content for your own use only.

Share your licence or login credentials with others

To the extent permitted by law, LU-TRITION and its representatives are not liable for any loss, injury, or damages (direct or indirect) resulting from use of our services or website, technical failures, data breaches, viruses, site outages or reliance and decisions made based on information or advice received. Nothing in these Terms excludes your rights under Australian Consumer Law.


Indemnity
You agree to indemnify LU-TRITION against any claims, losses or liabilities arising from your misuse of our services, breach of these terms or provision of inaccurate or misleading information you provide.


Amendments
We may update these Terms at any time. The latest version will always be available on our website and your continued use constitutes acceptance.
